JUSTICE RAKESH KUMAR ORAL ORDER 03-12-2018 Heard Sri Aditya Narayan Singh, learned counsel, assisted by Sri Gajendra Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody only since 2-07-2018 in Bela P.S. Case No. 25 of 2018 registered for offence under Sections 20, 22, 25, 27 of the Narcotic Drugs & Psychotropic Substances Act, has prayed for grant of bail primarily on the ground of parity.

It was submitted by learned counsel for the petitioner that one of the co-accused, namely, Brajendra Kumar Tiwary has been granted bail by a co-ordinate Bench of this Court on 09/10/2018 passed in Cr. Misc. No. 54541 of 2018 and, as such, a prayer has been made for granting bail to the petitioner.

No.70392 of 2018(2) dt.03-12-2018 2/2 On going through the material on record, it is evident that it was case of recovery of narcotic substances from the possession of the petitioner and, as such, even though one of the co-accused has been granted bail by a co-ordinate Bench of this Court, I am of the opinion that it is not a case for grant of bail at this stage.

The petition stands dismissed.
