JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-364(A) of the Indian Penal Code.

The statement of victim was recorded u/S 164 of the Cr.P.C. in which, he stated that it was co-accused, Raunak, who kidnapped him and so far as petitioner is concerned; it is alleged that one Abhishek came on 11-03-2015 to the place, where the victim was made captive by his kidnappers and except the aforesaid material, there appears to be nothing against the petitioner.

The petitioner is languishing in jail custody since 2105-2016 and does not have any criminal antecedent. Moreover, co-

No.42469 of 2016 (3) dt.25-11-2016 2/2 accused Raunak has already been granted privilege of bail by a coordinate bench of this court vide order dated 19-10-2016 passed in Cr. Misc. No. 45327 of 2016. It is also informed on behalf of petitioner that co-accused Md. Danish @ Md. Danish Waquar has also been granted privilege of bail by a coordinate bench of this court.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with K. Hat (Sahayak) P.S. Case No. 172 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Purnea. (Hemant Kumar Srivastava, J) A.K.V./- U T
