The petitioner is in jail custody since 16.09.2016 in connection with Arrah Nawada P.S. Case No. 310 of 2015 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire case is based on CCTV footage at ATM of the Union Bank of India on the date of occurrence and subsequently, the petitioner was made to confess his guilt. It is further submitted that such withdrawals to the tune of two lakhs in two days has not been possible and the petitioner is not put on T.I. Parade. Considering the nature of allegation made against the petitioner and that the confessional statement of the accused made before the police has no evidentiary value, let the petitioner above
