JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 16-09-2015 The present application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner with a prayer to recall the order dated 27th January, 2015 passed in Cr. W.J.C. No. 333 of 2014.

I have heard Mr. Sanjeev Kumar Mishra, learned counsel for the petitioner and learned counsel for the State. It is contended by learned counsel for the petitioner that after going through the counter affidavit filed on behalf of the State when the case was taken up on 27.01.2015, he thought it prudent to withdraw the case. However, as per instruction of

Patna High Court Cr.Misc. No.43525 of 2015 (2) dt.16-09-2015 3 / 3 his client the present application has been filed as the petitioner intends that his case be disposed of on merit. In my view, the application is misconceived.

Accordingly, it is dismissed.
