JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code and 3 / 4 of the Witch Craft Act.
Allegation against petitioner is of killing son of informant due to some old dispute.
It has been submitted on behalf of petitioner that he is in custody since 8.8.2016. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Merely on the basis of suspicion petitioner has been made accused in the present case. There is no substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Gaya , in connection with Atri P.S. Case
