====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 02-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in NTPC Khaira P.S. Case No. 12 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act. It is alleged in the written report that 660 litres of foreign liquor has been recovered from two Scorpio vehicles. It is further alleged that two persons started running away from the Scorpio vehicles on seeing the police party. The petitioner along with other eight accused persons as named in the written report has been apprehended by the Police.

The seizure list is part of the First Information Report from which it appears that there is no seizure of any illicit liquor from conscious possession of the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIIth-cum Special Judge (Excise), Aurangabad, in connection with NTPC Khaira P.S. Case No. 12 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
