This application for grant of regular bail arises out of Fatuha P.S. Case No.865 of 2024 registered for the offence punishable under sections 103(1) and 3(5) of the B.N.S., 2023.

The deceased is alleged to have been killed by the accused persons. The informant is not an eye witness to the incident but the eye witness is one Amit Kumar who has named the petitioner as one of the assailants, who along with other accused persons have fired which hit the deceased. 4.

The petitioner is in custody since 02.12.2024.

Learned APP for the State and the informant have opposed the prayer of the petitioner for grant of bail. 6.

Considering the fact that the petitioner and others are said to have fired at the deceased and killed him, I am not inclined to grant the petitioner privilege of regular bail. Accordingly, this bail application is rejected. 7.

The informant undertakes to cooperate in the trial. If the trial is delayed by the prosecution, the petitioner may renew his prayer for bail.
