The petitioner seeks bail in Ramnagar P. S. Case No. 165 of 2017 instituted for the offence under Section(s) 376, 313 and 504/34 of the Indian Penal Code.
Initially a complaint has been filed which was sent to police station U/s 156 (3) Cr.P.C. for registration of the FIR. It is alleged in the complaint that this petitioner continued to establish physical relationship with the informant for two years on the pretext of performing marriage with her. The informant became pregnant in the month of January 2017. Thereafter, petitioner denied to marry her. Panchayati was also held. The application to Sarpanch of Khatauri Gram Panchayat was given but no action was taken on her application
Patna High Court Cr.Misc. No.71034 of 2018(2) dt.10-12-2018 2/3 The father of informant went to the house of accused persons on 25.7.2017 and made request to marry her daughter. But the accused person abused and assaulted him. The informant reported the matter to Bagaha Mahila P.S. on 27.3.2017 and then accused no.3 promised to get her married with his nephew. Lastly on 30.3.0217 petitioner became ready to marry with her and lagan patrika was prepared and date of marriage was also fixed. Thereafter, the petitioner again started establishing physical relationship with her. The petitioner brought some medicine on 5.4.17 and advised the informant to take those medicine for the benefit of baby which caused miscarriage of three months old womb. It is alleged that marriage was to be performed on 14.4.2017. But in the meantime, on 12.4.2017 accused nos. 2 to 4 came to the door of informant and made demand of Rs. One lac and motorcycle as condition for marriage.
In this manner, from the narration of complaint petition, it appears that entire episode continued for more than two years with consent of the informant and petitioner. Learned counsel for the informant has appeared and opposed the prayer for bail.
Petitioner is in custody since 19.9.2018.

No.71034 of 2018(2) dt.10-12-2018 3/3 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Bagaha West Champaran., in connection with Ramnagar P. S. Case No. 165 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.
