10-04-2019 Heard Sri Jitendra Kumar Giri, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner has renewed his prayer for bail, in view of last observation of this Court, which was recorded in Cr. Misc. No. 49222 of 2018 on 20-08-2018. The petitioner was granted liberty to renew his prayer for bail after nine months of his custody. Such observation was recorded, keeping in view the fact that there was case and counter case in between the parties and dispute was relating to partition of property. My attention has been drawn to statement made in paragraph - 11 of the petition to show that petitioner is in custody since 19-06-2018 and has completed more than nine months in custody.

In view of such observation, there is no reason to

Let the petitioner namely Abhinandan Sah be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Saharsa, Distt.- Saharsa in connection with Saharsa Sadar P.S. Case No. 595 of 2018.
