JUSTICE SANJAY PRIYA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 30 and 36 of Bihar Prohibition and Excise Act, 2016.

It is alleged that 90 bottles of Royal Stag liquor containing one litre each and 113 bottles of Royal Stag liquor containing 375 ML each were recovered from a Maruti Omni Van. The petitioner along with another co-accused Ashok Paswan was found sitting in the aforesaid van.

It is submitted on behalf of the petitioner that he is in custody since 08.10.2016 and he has no criminal antecedent, which is mentioned in paragraph 10 of this application. It is

Patna High Court Cr.Misc. No.342 of 2017 (2) dt.28-01-2017 2/2 further submitted that the petitioner was driver of the aforesaid vehicle and the said vehicle was hired by another co-accused Ashok Paswan.

Keeping into consideration the period of custody and in the above facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S.Case No. 471 of 2016, subject to the condition that both the bailors will be the close relatives and also the co-villagers of the petitioner.
