JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This is an application for grant of anticipatory bail in connection with Durgawati P.S. Case No. 190 of 2018, disclosing offences under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of firing on the informant causing injury and there is allegation against other accused persons of assault to the informant.

Submission of learned counsel for the petitioner is that he is working in Navy and the whole allegation is false and concocted .

Heard learned A.P.P. also.

Having heard both sides, considering the fact that the petitioner is working in Navy and there is no chance of his abosconding, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.19541 of 2019(3) dt.07-05-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Durgawati P.S. Case No. 190 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that he has to cooperate in the investigation and appear before the Investigating Officer as and when required, otherwise the prosecution is at liberty to move for cancellation of his bail bonds.
