JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 120B of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act and Section 47 of the Excise Act.

One mobile, one live cartridge and one pouch containing 200 ml country made liquor are said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 27.04.2016. Moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail.

Considering the aforesaid facts and circumstances as

No.38811 of 2016 (2) dt.20-09-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 68 of 2016.
