JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 Petitioner prays for bail in connection with Chapra Rail P.S.Case No. 129 of 2018 registered for the offence punishable under Section 394 of the Indian Penal Code and later on Section 302 IPC was added.

Allegation as per FIR is that some miscreants assaulted the informant and one Sunil Kumar and snatched their luggage and due to assault Sunil Kumar succumbed to the injuries and petitioner is not named in the FIR and it appears from perusal of impugned order that his name transpired in the confessional statement of co-accused.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him, no recovery has been made from his possession and he has been acquitted in four other cases and two other cases he is on bail

Patna High Court Cr.Misc. No.70143 of 2018(2) dt.06-12-2018 2/2 and he is in custody since 31.8.2018.

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rail, Sonpur, District Saran, in connection with Chapra Rail P.S.Case No. 129 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
