The petitioner is apprehending his arrest in connection with Vaishali (Balsor O.P.) P.S. Case No. 97 of 2019 for the offence under Sections 401, 413, 414, 467, 468, 471 and 120B/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. He further submits that nothing has been recovered from the possession of the petitioner to connect him in the commission of crime. He further submits that the name of the petitioner surfaced on the basis of confessional statement of co-accused Raushan Kumar. He also submits that co-accused, namely, Chandan Kumar and Ranjan Paswan, have been granted anticipatory bail vide order dated 06.08.2019 passed in Cr. Misc. No. 49164 of 2019 and
Patna High Court CR. MISC. No.20402 of 2020(2) dt.07-07-2020 2/2 order dated 21.10.2019 in Cr. Misc. No. 63465 of 2019 respectively.
Considering the fact that co-accused have been granted anticipatory bail, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (Balsor O.P.) P.S. Case No. 97 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the further condition that the petitioner on release will render his service as volunteer for a period of one month in dedicated Covid Hospital. He is required to report to the District Nodal Officer in the concerned region, who shall utilize his service in this pandemic. (Anil Kumar Upadhyay, J) uday/- U T
