JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Complaint Case No. 2894 (C) of 2006 (Isuapur P.S. Case No. 20 of 2007) for the offence under Sections 323, 406 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 04.02.2019.

Referring to the prosecution case, he submits that the issue with regard to financial transaction was settled between the parties and after 12 years the daughter of the complainant has come and from her initiative, the petitioner has been subjected to the prosecution.
