NILU AGRAWAL ORAL ORDER 16-11-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

On earlier date i.e. 28.09.2016, a legible carbon copy of the case diary along with the report indicating as to the stage of trial was called for from the court of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 442 of 2015.

The report of the learned 2nd Additional Sessions Jude, Araria has been sent by the Letter No. 538 dated 04.10.2016, stating therein that the said case has been received on 23.04.2016 after commitment and is fixed for charge on 21.10.2016. The carbon copy of the case diary has also been received. It may be noted that the petitioner had earlier moved

Patna High Court Cr.Misc. No.42312 of 2016 (3) dt.16-11-2016 2/2 before this Court for grant of bail in Criminal Miscellaneous No. 15787 of 2016 which was rejected on 25.05.2016. From the perusal of the case diary, it appears that apart from the informant who is the wife of the deceased Umesh Yadav who is the eye witness, there are a number of witnesses who have named the petitioner.

Under such circumstances, I am not inclined to grant the privilege of bail to the petitioner at this stage. (Nilu Agrawal, J) Vats/- U T
