====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 26-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Murliganj P.S. Case No. 378 of 2021 lodged under Sections 25(1-b)a, 26/35 of the Arms Act.

Allegation against the petitioner is that during investigation, a raid was made at the house of the petitioner and in the residential house of the petitioner one desi pistol was recovered from the bed situated in room of his house. Learned counsel for the petitioner submits that only a pistol without any live cartridges were recovered. He further submits that recovery has not been made from the conscious possession of the petitioner. It has been recovered from the bed

He further submits that petitioner is in custody since 06.12.2021 that is about more than 6 months. He further submits that the antecedent of the petitioner is not clean but this case is of the year 2000. He further submits that charge sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances and the submissions made of this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Madhepura in connection with Murliganj P.S. Case No. 378 of 2021, subject to the conditions as laid down under Section 437(3) of the Cr.P.C.
