Petitioners are accused in Khagaria (Muffasil) P.S.Case o.429 of 2016 for an offence under Sections 341, 323, 324, 504, 379/34 and 307 of the Indian Penal Code.

The allegation against the petitioner No.1 (Polo Yadav) is that he assaulted Madan Yadav causing grievous injury on head and the petitioner No.2 (Mukesh Yadav), causing assaulted on Ranjeet Yadav, who has grievous injury on his right ring finger and the petitioner No.3 (Mikin Yadav) assaulted Ranveer Yadav. Patna High Court Cr.Misc. No.48841 of 2016 (2) dt.13-12-2016 2/2 custody since 21st August, 2016 and the charge-sheet has already been submitted.

In view of the facts that there is a case and counter case as well as allegation against the petitioner no.2 (Mukesh Yadav) causing grievous injury upon Ranjeet Yadav but on right ring finger and allegation against Mikin Yadav, causing injury upon Ranveer Yadav, which are simple in nature, let petitioner no.2 (Mukesh Yadav) and petitioner no.3 (Mikin Yadav) be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S.Case No.429 of 2016.

So far the allegation against petitioner no.1 (Polo Yadav) is concerned, he has caused injury on head of Madan Yadav, which is grievous in nature, his prayer for bail is rejected at this stage, however, trial court is directed to expedite the trial. (Vinod Kumar Sinha, J) chn/- U T
