The petitioner is accused in connection with Delha P.S. Case No. 08 of 2015 registered under sections 366(A)/34 of the I.P.C. pending in the Court of A.C.J.M.-VII, Gaya. The accusation against the petitioner is that sister of the informant aged about 14 years disappeared from his house and on search, petitioner and one co-accused Baby Devi replied that they have performed her marriage with a boy.
Submission of learned counsel for the petitioner is that petitioner is innocent and has committed no offence. It is also submitted that petitioner is in custody since 18.08.2016. Learned A.P.P. appearing on behalf of the State
Patna High Court Cr.Misc. No.54013 of 2016 (4) dt.16-01-2017 2/2 submits that petitioner is involved in human trafficking of minor girl, victim Asha Kumari, aged about 17 years, whose statement was recorded under Section 164 Cr. P.C., in which she stated that petitioner and the said co-accused sold her, thereafter, she was sexually harassed.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Shail/- U T
