The petitioner seeks bail in a case registered under Sections 429, 295A/34 of the Indian Penal Code as well as 414(2) of Bihar Presentation of Improvement of Animal Act, 1955 and Section 38(3) of Prevention of Cruelty to Animal Act, 1960 and Sections 43(1),(2),(3)/48, 49(1)(2) of Transportation of Cattle Act, 1998.

The prosecution case, in short, is that a pick up van and some trucks loaded with beef and flesh were caught by the S.H.O., Haspura and other officials.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.20038 of 2019(3) dt.08-05-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to be the driver of the truck in question, which was carrying the cattles to the slaughter house. The petitioner was not apprehended on the spot. His name has come on the confessional statement of coaccused. Other co-accused has been granted bail vide Cr.Misc.No.51494 of 2016.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad in connection with Haspura P.S. case No.189 of 2016.
