JUSTICE RAMESH KUMAR DATTA ORAL ORDER 03-12-2015 A supplementary affidavit has been filed on behalf of the petitioners stating that the statement made in para 1 of the main application is to be rectified as also the name of the petitioner no. 2 is stated to be correctly read as Jitendra Kumar alias Jitendra Yadav.
Let the necessary corrections be made by learned counsel for the petitioner in the case heading in the course of the day.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor, for the State. The petitioners pray for anticipatory bail in a case registered under Sections 341, 323, 324, 307,504/34 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.43274 of 2015 (3) dt.03-12-2015 2/2 petitioners that the allegations against the petitioners are omnibus and in general character and there is no allegation that the petitioners have fired from their weapons, rather the allegation of firing is only against the co-accused Rajesh Yadav. It is further submitted that the injury report speaks only of pellet injuries, which does not support the statements made in the first information report. Learned counsel for the petitioners also submits that the petitioners do not have any criminal antecedent.
On a consideration of the facts and circumstances of the case, it is directed that the petitioners (1) Bachchan Singh ,(2) Jitendra Kumar alias Jitendra Yadav and (3) Rabindra Yadav @ Ravindra Singh, in the event of their arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Fatuha P.S. Case No. 219/2015 to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, Patna, subject to the conditions laid down under Section 438 (2) Cr. P.C.
