This application for grant of anticipatory bail arises out of Jehanabad (Kalpa) P.S. Case No. 148 of 2014, disclosing offences under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.
The petitioner, at the relevant point of time, working as Branch Manager of the State Bank of India of Kalpa Branch. He is said to have sanctioned Kishan Credit Card loans to 36 farmers, to the tune of Rs. 54,95,000/- on the basis of Land Possession Certificates issued in favour of the loanees, which were found to be false and forged.
Patna High Court Cr.Misc. No.561 of 2015 (4) dt.28-08-2015 2/3 A supplementary affidavit has been filed on behalf of the petitioner bringing on record, a copy of the letter dated 12.01.2015 issued by the Circle Officer, Kako containing the list of loanees who possessed the land, on the basis of which, they were granted the loan amount, as indicated above. Learned counsel on behalf of the petitioner has also submitted that the nature of allegation as contained in the First Information Report is such that there is no chance of tampering with the evidence. He also submits that the petitioner being an Officer of the Bank is not likely to misuse the privilege of anticipatory bail, if granted.
Considering the submissions as above, this application is allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad (Kalpa) P.S. Case No. 148 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner
Patna High Court Cr.Misc. No.561 of 2015 (4) dt.28-08-2015 3/3 shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
