This is a petition for grant of regular bail for offence under Sections 302, 201, 120B and 34 of the Indian Penal Code. According to first information report the petitioner is suspected to have committed murder of Rukhsar. Suspicion is because Rukhsar had went away from her house along with Wajda Parveen and Wajda Parveen disclosed the informant that Rukhsar had gone along with the petitioner and others on a motorcycle, thereafter dead body was received.

The learned Additional Public Prosecutor conceded that there is no eye witness in the case diary rather suspicion is strong against the petitioner. No motive is alleged against the petitioner.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nauhatta P.S. Case No. 223 of 2015 to the satisfaction of the Additional Chief Judicial Magistrate, III, Saharsa, or successor Court. (Birendra Kumar, J) SA/- U √ T √
