The petitioner apprehends her arrest in Piprahi P.S. Case No.108 of 2018 registered under Section 366A and 34 of the Indian Penal Code.

The father of the victim alleged that his daughter had gone to withdraw money from the Bank but she did not return. During the course of search, the informant came to know that the petitioner(Indu Devi), Shivnath Kumar Yadav, Devendra Rai, Alok Kumar Yadav, Samarendra Kumar Yadav and others kidnapped his daughter.

The learned counsel for the petitioner submits that the informant is not an eyewitness of the occurrence. The victim who is wife made her statement under Section 164 Cr.P.C. and disclosed that Shivnath and his two uncles namely, Hari Rai and

Patna High Court Cr.Misc. No.74990 of 2018(2) dt.20-12-2018 2/2 Rajendra Rai kept her in a Bolero. Shivnath took her to Chennai. The victim did not disclose the name of the petitioner. Considering the fact that victim did not disclose the name of the petitioner in her kidnapping, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Raj Kumar, J.M. 1st Class, Sheohar in connection with Piprahi P.S. Case No.108 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
