JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-11-2015 Petitioner being Chairman of the PACS is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code. The prosecution case is that petitioner was allowed to purchase 1108.20 quintals of paddy out of which he supplied 495 quintals of paddy to the S.F.C but rest 613.20 was not supplied due to the inferior quality. The PACS committee on 15.08.2013 decided through proposal No. 4 that the said inferior quality of paddy may be sold in the open market at the rate of Rs. 1,000/-.
It is submitted by learned counsel for the petitioner that petitioner has deposited Rs. 6, 11,000/- and this fact has not been controverted by Ms. Jyotsana Kumari, learned counsel appearing on behalf of The Bihar State Food &
Patna High Court Cr.Misc. No.42772 of 2015 (3) dt.02-11-2015 2/2 Civil Supplies Corporation.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 200 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
