1. The petitioner has filed the present writ application for direction to the respondent-authorities to rectify the incorrect entries in the ePOS Machine provided to the petitioner.

2. Learned counsel for the petitioner submits that due to technical fault there is discrepancy in online data of the stock with reference to actual physical food grains available in the PDS shop.

Patna High Court CWJC No.6193 of 2025(6) dt.19-11-2025 2/3 Block Development Officer-cum-Block Supply Officer, Mahua, Vaishali, in this regard on 27.07.2020, but no action whatsoever has been taken up till now.

4. I haver heard learned counsel for the parties and have gone through the materials available on record.

It appears that the Principal Secretary, Food and Consumer Protection Department, Govt. of Bihar, Patna, vide its letter no. 2815, dated 31.05.2024, has directed all the District Magistrate of the State to provide report, in prescribed format, with respect to discrepancy found in the entries made in the ePOS machine and physical stock of the PDS dealers. The dealers have also been advised to file a complaint, in prescribed format, for rectification of discrepancy in the physical stock vis-a-vis ePOS machine along with supporting documents.

The petitioner, in the light of the aforesaid letter, dated 31.05.2024, and/or letter of department, dated 28.07.2023, has not filed any application for rectification of the data in the ePOS machine. Accordingly, the present writ application, is being disposed with direction to the petitioner to file a complaint for rectification of discrepancy in the ePOS machine along with supporting

Patna High Court CWJC No.6193 of 2025(6) dt.19-11-2025 3/3 evidence/documents within a period of 15 days from today before the District Magistrate, Vaishali.

7. If such a complaint/application is filed by the petitioner, the District Magistrate, Vaishali, is directed to dispose the same in accordance with law and after taking into account the relevant materials produced by the petitioner and/or concerned authority within a further period of two months.

8. With the aforesaid observations and directions, this writ application is, accordingly, disposed.
