JUSTICE BIRENDRA KUMAR ORAL ORDER 06-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366 and 379/34 of the Indian Penal Code.

Allegation is of abduction of a married girl. The victim in her statement under Section 164 Cr.P.C. stated that she had love affairs with petitioner no. 1 Kartik Kumar and she had fled away with him and has already married with him.

Considering the statement of the victim-girl, let the

No.14600 of 2017 (2) dt.06-04-2017 2/2 petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasarsa/successor Court in connection with Saur Bazar Police Station Case No. 320 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
