JUSTICE RAKESH KUMAR ORAL ORDER 03-12-2018 Heard Sri Amrit Abhijat, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner who is in custody only since 27.08.2018 in connection with Khutauna P.S. Case No. 32 of 2018 , corresponding to G.R. No. 374 of 2018 registered for the offence under Section 307/34 of the Indian Penal Code, 1860 and Section 27 of the Arms Act, 1959 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has been arrayed as accused only on the basis of confessional statement of co-accused. There is no recovery. However, considering the seriousness of the accusation as explained in the F.I.R. and the fact that petitioner is having criminal antecedent which fact has been stated in paragraph 3

Patna High Court Cr.Misc. No.70376 of 2018(2) dt.03-12-2018 2/2 of the petition, presently I do not find any ground to pass favourable order.
