Mr.Indeshwari Prasad Mandal For the Opposite Party/s :

Mr.Sri Tarun Prasad Mandal ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-06-2019 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in connection with Nathnagar (Madhusudanpur) P.S. Case No. 372 of 2018 registered for the offence punishable under sections 341, 323, 498A, 304B/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely because he is husband of the deceased. Petitioner never demanded any dowry nor tortured the deceased ever.

The Court by the order dated 07.03.2019 had called for the chemical analysis report, which is received.

Patna High Court CR. MISC. No.73276 of 2018(5) dt.20-06-2019 2/2 Perusal of the report shows that Aluminium Phosphide (Celphos) was detected in the contents of the glass jar. The F.S.L. supports the allegations levelled against this petitioner. Considering the nature of allegations levelled, the report of the Forensic Science Laboratory and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected. (Arvind Srivastava, J) mcv/- U T
