The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 17.03.2016 passed Cri. Misc. No. 3901 of 2016, on the ground that the petitioner is suffering in custody since 05.08.2015 for more than one year and in near future the trial is not likely to be concluded, up till now only four prosecution witnesses have been examined and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes by pointing out the alleged recovery.
In the facts and circumstances stated above, considering the alleged recovery, at present, I am not inclined to
Patna High Court Cr.Misc. No.40453 of 2016 (2) dt.21-09-2016 2/2 enlarge the petitioner on bail, accordingly, his such prayer again stands rejected.
However, the learned trail Court is directed to expedite the trial and conclude the same preferably within three months after taking the same on priority basis, failing which if the petitioner at no fault, may be at liberty to renew his prayer for bail. (Jitendra Mohan Sharma, J.) Rajiv/- U T
