This is a petition for grant of anticipatory bail for offence under Sections 25(1-b)A, 26 and 35 of the Arms Act and 414 of the Indian Penal Code.

Two persons were apprehended along with a sumo four wheeler. There as no paper of the four wheeler, hence, the same was seized suspecting the same to be stolen property. From the possession of the arrested person fire arm and cartridges were recovered. They disclosed that the petitioner was also there and fled away. Submission of the petitioner is that The petitioner has stated on oath that he has got no criminal antecedent and the statement of the co-accused before the police is no evidence against the petitioner.

Patna High Court Cr.Misc. No.20671 of 2017 (2) dt.11-05-2017 2/2 Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Dihri Nagar P.S. Case No. 121 of 2017 to the satisfaction of the Subdivisional Judicial Magistrate, Dehri, Rohtas at Sasaram, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
