1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 379, 384, 411 and 34 of the Indian Penal Code.
3. The informant alleges that he was in touch with one Shrikant Tiwari on his mobile number for buying pure gold at a cheaper price, further being lured by the said offer to purchase pure gold at a cheaper rate, the informant along with his brother contacted to Shrikant Tiwari and thereafter they were taken to the village of Radhiya and were brought to the house of one Ajit Kumar Dwivedi, it is next alleged
Patna High Court CR. MISC. No.23407 of 2023(2) dt.14-07-2023 2/3 that informant agreed to purchase pure gold of worth Rs. 4,20,000/-. The money was handed over but the gold was not given and suspecting the transaction the brother of the informant took the money back from the person to whom it was delivered. It is further alleged that 8-10 persons came and threatened the informant and his brother and when the police arrived they were saved.

The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that the petitioner is not named in the FIR and his name transpired during the course of investigation. It is further submitted that Srikant Tiwari has been granted the privilege of anticipatory bail by order dated 17.05.2023 in Cr. Misc. No. 4201 of 2023.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner abovenamed, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today,
