JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 302 & other minor sections of the Indian Penal Code.

Petitioner and one co-accused Ranjeet Singh are said to have, mercilessly, assaulted the deceased causing head injury to him. The postmortem report goes to show that multiple injuries were found on the scalp of the deceased.

Submission on behalf of the petitioner is that there was dispute between co-accused Hare Ram Singh and prosecution party and, the petitioner does not have any concern either with the prosecution party or with the co-accused Hare Ram Singh as well

Patna High Court Cr.Misc. No.38815 of 2016 (4) dt.21-11-2016 2/2 as his family members but due to village politics, he has been implicated in this case. It is further submitted that moreover, in course of investigation, almost all the witnesses stated that it was Anjani Singh and Sanjeev Singh, who gave fatal blow to the deceased.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Khodawandpur P.S. Case No. 23 of 2016 corresponding to Sessions Trial No. 401 of 2016 stands rejected. However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible.
