2. The petitioner seeks bail in connection with Saharsa Sadar P.S. Case No. 470 of 2023 instituted for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504 of the Indian Penal Code.

3. The allegation against the petitioner along with others is of assaulting the wife of the informant, due to which she sustained injury.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. He submitted that both parties are Gotiya and there is admitted land dispute between them. From the perusal of the injury report, the

Patna High Court CR. MISC. No.27795 of 2024(2) dt.18-04-2024 2/2 doctor opined that the injury sustained to the informant's wife is grievous in nature. Charge-sheet has been submitted in this case. The petitioner is in custody since 11.01.2024 and has two criminal antecedents.

5. Learned APP for the State opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail after framing of charge, if already not framed, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Saharsa Sadar P.S.
