====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Rampur P.S. Case No.290 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The accusation is that in course of checking of the vehicles, one Mahindra Supro Maxi vehicle without registration number was stopped. The aforesaid vehicle was being driven by this petitioner in which Akash Kumar, the son of the owner of the truck, was sitting. On checking of the vehicle, 427.80 liters Indian Made Foreign Liquor, kept in different cartoons and bottles, was recovered.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.71220 of 2018(2) dt.04-12-2018 2/2 submits that, in fact, the petitioner had no knowledge about the loading of the aforesaid Indian Made Foreign Liquor in the vehicle as the petitioner was simply driver of the aforesaid vehicle. The petitioner has got no criminal antecedent and is in custody since 08.08.2018. On investigation, the police has submitted charge-sheet against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Gaya, in connection with Rampur P.S. Case No.290 of 2018. Out of the two sureties, one must be either parents or close relative of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
