JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend arrest in connection with Kursela P.S. Case No. 11 of 2015 registered under Sections447, 384, 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the present first information report has been lodged after four months of the alleged occurrence; however, there is no explanation for the delay. No specific allegation or overt act has been alleged against these petitioners. Similarly situated coaccused persons have been granted bail by the Court below itself vide order dated 27.09.2016 passed in Bail Application

Patna High Court Cr.Misc. No.10364 of 2017 (2) dt.22-03-2017 2/2 No. 1142 of 2016.

Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Kursela P.S. Case No. 11 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
