The petitioners apprehend their arrest in Kuchaikot P. S. Case No. 248 of 2016 registered for the offences under Sections 341, 323, 324, 427, 354, 379, 504 and 34 of the Indian Penal Code.
The informant alleged that the petitioners and others were cutting the trees standing in her field, when she objected, the petitioners assaulted her with fists and slaps and torn her clothes.
It is submitted that the specific allegation of assault is made against Vinay Manjhi. There is a counter version bearing
Patna High Court Cr.Misc. No.10394 of 2017 (3) dt.17-04-2017 2/2 Kuchaikote P.S. Case No. 247 of 2016 lodged by Rambilash Manjhi (petitioner no.1). There is a land dispute between the parties.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Gopalganj in Kuchaikot P. S. Case No. 248 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
