The petitioner seeks bail in Special Case No. 1280 of 2019 arising out of Gardanibagh P.S. Case No. 78 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition Excise Act.

Counsel for the petitioner submits that there is no recovery from conscious possession of the petitioner. The informant got information that one person is involved in selling illegal toddy.

From the seizure list it appears that 35 litres of toddy has been recovered from near Gardanibagh High School, Road No. 14.

Petitioner is in custody since 4.2.2019 having clean

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 1280 of 2019 arising out of Gardanibagh P.S. Case No. 78 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
