Petitioner is languishing in custody since 01.09.2016 in connection with Barachati P.S. Case No. 340 of 2016 for the offences punishable under Sections 272/273/120B of the Indian Penal Code and Section 47(a)/48(2)/52/63 of the Bihar Excise (Amendment) Act, 2016.
The petitioner was driver of the bus on which some other passengers were traveling and from the bag of passengers foreign liquor was recovered on 01.09.2016. Submission of the petitioner is that the petitioner was simply the driver of the public vehicle and nothing was to the knowledge of the petitioner as to which passenger was carrying what type of article.
Patna High Court Cr.Misc. No.51779 of 2016 (2) dt.30-11-2016 2/2 Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Barachati P.S. Case No. 340 of 2016.
