====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-07-2020 Heard learned counsel for the parties.

This application for regular bail arises out of Karja P.S. Case No. 315 of 2019, disclosing offences punishable under Sections 393 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

It is the case of the prosecution that on 26.11.2019, the informant was coming back to his house after withdrawing some cash from the Bank, when three accused persons on a motorcycle intercepted him and when the informant attempted to flee away they opened fire. Though the shots touched the jacket, which the informant was wearing, he did not receive any firearm injury, however, no valuables were snatched from the informant.

No.20340 of 2020(4) dt.10-07-2020 2/2 Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has been falsely implicated in the case, in which, charge sheet has already been submitted and that the petitioner is in custody since 11.12.2019. Considering the facts and circumstances, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Karja P.S. Case No. 315 of 2019.
