Petitioner seeks bail in Kalyanpur P.S. Case No.170 of 2018 instituted for the offence under Section(s) 364, 366/34 Indian Penal Code.

It is alleged in the Complaint Petition, which was sent to P.S. under Section 156(3) Cr.P.C, that wife of the Complainant left for her Naihar with two children as named in the Complaint Petition. The Complainant telephoned in his Sasural to know about his wife, then, he learnt that they have not reached there. The Complainant learnt from the witnesses that Raj Kumar Das was also seen with the wife and children of this petitioner. It is further alleged that the Complainant went to the house of Raj Kumar Das and enquired from this petitioner,

Patna High Court CR. MISC. No.27748 of 2019(2) dt.30-04-2019 2/2 who did not give any reply. Petitioner is father of Raj Kumar Das.

Counsel for the petitioner submits that he has been made accused merely on suspicion.

Petitioner is in custody since 23.12.2018 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Kalyanpur P.S. Case No.170 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
