2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 436, 504, 506/34 of the Indian Penal Code.
3. As per the F.I.R., it is alleged that due to previous enmity, all the F.I.R. named accused persons including these petitioners set the house of the informant on fire and when the informant protested, petitioner No. 1 assaulted her and outraged her modesty. It is next alleged that when one Ravishan Nishan came to save the informant, she was also assaulted. It is further alleged that these petitioners threatened the informant and her husband to kill them.

Learned counsel for the petitioners submits that from bare perusal of the F.I.R., it is apparent that dispute arose between the parties for passing the cattle through the gali for which scuffle took place between them and both sides sustained injuries. Case and counter case. Allegation of setting the house on fire is absolutely false and fabricated and during investigation, house of the informant was not found burnt by the police. He lastly submits that rest of the allegations are ornamental in order to make the grave.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P. S. Case No. 391 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
