JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Siwan Town P.S. Case No. 492 of 2016 registered under Sections 387 and 388/34 of the Indian Penal Code.

The accusation is of making demand of ransom of Rs.2,00,000/- by four persons named in the F.I.R. including the petitioner to the informant and also giving threatening of dire consequences to the informant and his family members. Learned counsel for the petitioner submits that petitioner, informant and other accused are of same Mohalla and due to enmity informant has lodged this false case about demanding of ransom and giving threatening of dire consequences

Patna High Court Cr.Misc. No.215 of 2017 (2) dt.12-01-2017 to the informant and his family members by the petitioner and three others. It is further submitted that while the petitioner is accused in two other cases, but in both cases, he is on bail and in the present case, he is in custody since 16.09.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Siwan Town P.S. Case No. 492 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
