JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sadar (Mabbi O.P.) P.S. Case No. 462 of 2016, registered under Sections 363 and 366(A) of the Indian Penal Code. The accusation is of kidnapping the daughter of informant, aged about 16 years, by eight persons named in the F.I.R. including the petitioner in the night of 26.11.2016. Learned counsel for the petitioner submits that, in fact, there was love affairs in between the daughter of informant and the petitioner and the daughter of informant left her parental house with this petitioner according to her own sweet will and performed

Patna High Court Cr.Misc. No.12841 of 2017 (3) dt.04-07-2017 the marriage with this petitioner as detailed in her statement recorded under Section 164 of the Cr.P.C., which would appear from paragraph 47 of the case diary.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Sadar (Mabbi O.P.) P.S. Case No. 462 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
