2 The petitioner apprehends arrest in Sasaram Town (Darigaon) PS Case No 195 of 2021 dated 13.03.2021 registered for the offence punishable under Section 395 of Indian Penal Code.
3 As per the prosecution case, all the FIR named accused persons including this petitioner stopped the truck bearing registration No JH02N 9721 on the point of pistol and unseated the driver and khalasi of the truck and, thereafter, they snatched money and mobile phone of the informant and codriver and forced them to sit in the Brezza car. 4 Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.22602 of 2023(5) dt.04-09-2023 2/2 petitioner has been made accused in this case on suspicion. No looted article has been recovered from his possession and he has got clean antecedent.
5 Learned APP has vehemently opposed the prayer for anticipatory bail.
6 Considering the rival submissions, in the event of arrest/surrender within a period of six weeks from today, the petitioner above named be enlarged on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram Town (Darigaon) PS Case No 195 of 2021 subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure.
