The petitioner, namely, Sanjay Sao @ Sanjay Kumar Sao @ Karu Sao apprehends his arrest in Magadh Medical P.S. Case No.87 of 2015, G.R. No.3461 of 2015 under Sections 2(e), 3, 5(b), 18 of Bihar Mahua Flower Act and 47(A), 47(F), 13(F) and 48 of Excise Act.
The learned counsel for the petitioner submitted that this is his first offence and that only 20 litre country made liquor has been recovered.
On the other hand, learned A.P.P. objected the prayer and submitted that Taslas etc. have also been recovered which are used
Patna High Court Cr.Misc. No.42221 of 2015 (2) dt.14-10-2015 in preparing of country made liquor.
Considering the allegation that the country made liquor has been recovered from the house of the petitioner and the materials which are used in preparation of country made liquor, I am not inclined to grant him anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected.
