The petitioner is accused in connection with Goreyakothi P.S. Case No. 20 of 2016 registered under Sections 363 and 366A of the Indian Penal Code and later on Section 302 of the Indian Penal Code has been added.
The accusation is of kidnapping of minor daughter of informant by Vikash Mahto with the help of his mother Kewal Devi and brother (petitioner) with intention to perform the marriage.
Learned counsel for the petitioner submits that, in fact, there was love affairs in between Vikash Mahto, brother of the petitioner, and Lakshmi Devi, daughter of informant, and both left

No.3234 of 2017 (3) dt.22-02-2017 the village and started to live in Village Sillibari, District Simla, which would appear from paragraphs 95 and 121 of the case diary, in which, statement of Ex-Gram Pradhan of Sillibari Village and Sunita Kashyap, owner of rented house of co-accused, Vikash Mahto and Lakshmi Devi, have been recorded. Both have stated about sustaining burn injury by Lakshmi Devi and carrying her by Vikash Mahto for treatment at I.G.M.S. Chandigarh, where she died. It is further submitted that petitioner being the brother of coaccused Vikash Mahto has been implicated in this case and he is in custody since 05.10.2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Goreyakothi P.S. Case No. 20 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
