Petitioner seeks bail in connection Minapur P.S. Case no. 595 of 2019 registered for the offence punishable under section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 24.01.2021 and charge sheet has been submitted. Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that on 27.11.2019 at about 7 p.m, while he was returning to his house and when he reached near petrol pump north from Dharampur, six persons looted his Glamour motorcycle on the point of pistol. He further submits

Case no. 545 of 2019 on 22.1.2020 and based on confessional statement in that case petitioner came to be implicated in the present case when nothing has been recovered from his possession nor petitioner has been put on TI parade.

Learned APP opposed the prayer for bail.

Considering the facts that petitioner is in jail custody, charge sheet has been submitted and till date no TI parade has been conducted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Minapur P.S. Case no. 595 of 2019.
