JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Gaya Muffasil P.S. Case No. 31 of 2019 for the offenses under Sections 413 and 414/34 of the Indian Penal Code. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. Referring to the prosecution case he submits that allegation against the petitioner is that he was involved in transaction of stolen motorcycle. The petitioner is in custody since 27.1.2019 and nothing incriminating was recovered from the conscious possession of the petitioner.

Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged
