Heard learned counsel for the petitioner and Mr. Nand Kishore Prasad, learned A.P.P. for the State. Petitioner in the present case is seeking pre-arrest bail in connection with Rivilganj P.S. Case No.184 of 2019 registered for the offences under Sections 341, 323, 504, 506, 427 and 354/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that it is a case of false implication on general and omnibus kind of allegation that this petitioner along with co-accused had assembled at the house of the informant and was indulged in firing. It is submitted that no injury has been caused in the

No.20275 of 2020(2) dt.24-07-2020 2/3 alleged firing and the co-accused namely, Dhanji Singh @ Dhanji Kumar Singh, Manji Singh, Sohan Singh and Pappu Singh @ Santosh Singh @ Santosh Kr. Singh have been granted privilege of anticipatory bail by learned coordinate Bench of this court in Cr. Misc. No. 58731/2019 vide order dated 18.09.2019. It is further submitted that the previous enmity between the parties is there and prior to the alleged occurrence the petitioner's cousin Vikas Kumar had lodged a case being Rivilganj P.S. Case No. 13/2019 against the husband of the informant and his brother who are having huge criminal antecedent.

Learned A.P.P. for the State has though opposed the prayer for anticipatory bail of the petitioner but considering the facts and circumstances of the case wherein there are general and omnibus allegation of firing and the similarly situated coaccused have been granted privilege of anticipatory bail by learned coordinate Bench of this Court, let the petitioner above named in the event of his arrest or surrender within a period of six weeks from today in connection with Rivilganj P.S. Case No.184 of 2019 be released on bail on furnishing of bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Pramod Ranjan, J.M.-

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) a condition that the person shall not leave India without the previous permission of the Court.
